These Terms of Use ("Terms") govern your access to and use of the websites, applications, tools, and services operated by Justmindsettrade ("Justmindsettrade", "JMT", "we", "our", or "us"), including justmindsettrade.com and any related web or mobile applications (collectively, the "Platform"). These Terms form a binding legal agreement between you ("User", "you", or "your") and Justmindsettrade. By accessing, browsing, registering for an account on, or otherwise using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms, together with our Privacy Policy, Risk Disclosure, and any other policies or rules referenced herein, which are incorporated by reference. If you do not agree to these Terms, you must discontinue use of the Platform immediately. If you are accepting these Terms on behalf of a company or other legal entity, you represent and warrant that you have authority to bind that entity.

Acceptance of Terms

By accessing, browsing, or registering to use the Platform, you agree that these Terms, our Privacy Policy, our Risk Disclosure, and all applicable rules and notices constitute a binding legal agreement between you and Justmindsettrade, and you agree to comply with all applicable laws and regulations. These Terms set out the rights, responsibilities, and limitations of your use of the Platform, Services, and Content. We reserve the right to modify these Terms at any time as described in Section 3. Your continued use of the Platform after any change constitutes your acceptance of the modified Terms.

Modifications to These Terms

We may modify, amend, or update these Terms and any policies referenced herein at any time, in our sole discretion, with or without prior notice. Unless otherwise stated, changes become effective upon posting the updated Terms (or upon the indicated "Last Updated" date) on the Platform. For material changes, we may provide additional notice — such as a banner on the Platform, an in-product message, or an email — where required by law. Your continued access to or use of the Platform after the effective date of any change constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Platform and, where applicable, close your account. Any rights and obligations that accrued prior to the effective date of the changes will survive. We may also modify, suspend, or discontinue any feature, Service, or Content, or impose new limits, at any time, without liability to you.

Eligibility & Registration

License & Acceptable Use

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, and revocable license to access and use the Platform strictly for educational and personal, non-commercial purposes. You may not reproduce, redistribute, resell, publish, modify, reverse-engineer, or otherwise exploit any part of the Platform, Services, or Content without our prior written consent. You agree not to use the Platform in any manner that is unlawful, infringes the rights of others, or interferes with the operation, security, or integrity of the Platform. We reserve all rights not expressly granted to you in these Terms.

Purpose of the Site — No Advice

Justmindsettrade is an educational platform providing learning materials, training tools, analytical software, and behavioral feedback systems for traders. The Platform does not provide investment advice, does not engage in asset trading or brokerage services, and does not promote or recommend any financial instrument, broker, or investment. The Platform is intended solely for educational and informational purposes. Nothing on the Platform constitutes financial, legal, tax, or investment advice, a recommendation, an offer, or a solicitation. Any interpretation, prediction, or decision you make based on the Platform's Content or tools is solely your responsibility.

Risk

Trading financial instruments — including foreign exchange, contracts for difference (CFDs), cryptocurrencies, equities, and other products — involves a high level of risk and may not be suitable for everyone. You may lose part or all of your capital, and with leveraged products you may lose more than your initial deposit. Do not trade with money you cannot afford to lose.

Before using the Platform, please read our full Risk Disclosure, which forms part of these Terms and is incorporated herein by reference.

Broker Partner Policy

Justmindsettrade is an independent educational platform. We are not a broker, market-maker, custodian, or investment adviser, and we do not hold client funds or execute trades.

We may list or link to third-party brokers or affiliates ("Partners") and may receive referral or introducing-broker (IB) fees if you open an account or trade through our tracking links. This does not affect your costs, spreads, or pricing. Any references to Partners are provided for your convenience and do not constitute an endorsement, recommendation, or solicitation.

There is no agency, partnership, joint venture, or control between Justmindsettrade and any Partner. Partners operate independently; they are not our agents and are not under our control.

All matters — including account opening and closure, KYC/AML checks, trading terms, fees, execution, pricing, platform availability, deposits and withdrawals, promotions, and customer support — are strictly between you and the Partner.

Any benefits (including rebates) are determined by the Partner and depend on proper tracking and eligibility under the Partner's rules. Tracking may fail due to, without limitation, cookie deletion, ITP or privacy settings, ad-blockers, VPNs, deep-link or in-app flows, late or incorrect linking, duplicate or previous accounts, or the Partner's rules. We do not backdate, manually credit, or guarantee any tracking or payout.

Listings and the order of Partners on the Platform are not rankings, recommendations, or guarantees. Availability may change without notice.

You must conduct your own due diligence and ensure compliance with applicable laws and regulations in your jurisdiction before using any Partner. We do not mediate disputes between you and any Partner — please contact the Partner directly for account, promotion, or trade-related issues.

To the maximum extent permitted by law, Justmindsettrade disclaims all liability for Partner platforms, content, products, services, programs, or promotions, and for any direct, indirect, incidental, special, consequential, punitive, or exemplary damages arising from or related to your interactions with any Partner.

Where required to verify eligibility, we may receive limited account identifiers or aggregated trading data from a Partner for validation and reporting purposes only, handled in accordance with our Privacy Policy.

Third-Party Links & Content

The Platform may display or provide links to Third-Party Services for your convenience. We do not control Third-Party Services and do not endorse or warrant their availability, accuracy, completeness, security, timeliness, pricing, policies, or practices.

The presence of a link does not constitute an endorsement, recommendation, agency, partnership, or affiliation with any third party.

Your access to and use of Third-Party Services is entirely at your own risk, and you must conduct your own research and due diligence, including verifying licensing and legality in your jurisdiction.

Once you leave the Platform, the third party's terms of use, privacy policy, and cookie policy apply. Our Privacy Policy does not govern their practices. Certain identifiers — such as device or account IDs, referral parameters, or analytics data — may be transmitted pursuant to your settings and the third party's tracking technologies.

Some links may be referral or affiliate links for which we may receive compensation if you sign up or transact. This does not increase your cost or transform our educational Content into investment advice. Tracking may fail for technical or other reasons.

Any claims, disputes, or service issues are between you and the third party. Justmindsettrade does not mediate and is not a party to your relationship with any third-party provider.

To the maximum extent permitted by law, Justmindsettrade shall not be liable for any direct, indirect, special, incidental, consequential, or exemplary damages arising out of or in connection with your access to, use of, inability to use, delay of, changes to, suspension, or discontinuation of any Third-Party Services.

We are not obligated to review, monitor, or update Third-Party links or content, and we accept no responsibility for errors, outages, or security events originating from such third parties. We may add, remove, or re-order any Third-Party links at our sole discretion, at any time, with or without notice.

References to Third-Party Services are for educational and informational purposes only and shall not be construed as investment advice or a solicitation to buy or sell any financial instrument.

Intellectual Property Rights

All rights, title, and interest in and to the Platform and all Content are owned by Justmindsettrade or its licensors. No rights are granted to you except the limited rights expressly stated in these Terms.

The Marks, whether registered or unregistered, in Thailand and worldwide, are the exclusive property of Justmindsettrade. Nothing in these Terms grants you any license to the Content or the Marks, whether by implication, estoppel, or otherwise.

Without our prior written consent, you must not:

You may refer to the name "Justmindsettrade" solely to truthfully identify our Services in a non-misleading, non-promotional manner, without using our logos and without implying endorsement or affiliation. Any other use requires prior written consent.

We reserve all rights to demand the removal, transfer, or disabling of infringing domains, handles, or ads, and to pursue all legal and equitable remedies. All third-party trademarks appearing in connection with the Services remain the property of their respective owners; their appearance does not imply any affiliation, endorsement, or sponsorship by Justmindsettrade.

Communications

By becoming a Justmindsettrade user, you agree to receive communications that are account and user-related — for example, that we have added cashback to your account or paid out funds — as well as periodic trading-related notifications about special offers available to Justmindsettrade users. We may communicate with you by electronic communications or direct mail using information you provide during registration. Your consent to receive electronic communications includes any notices or information that we may be required by law to provide in writing. You agree to keep your current email address up to date should the same change subsequent to the date you become a member. We may also send you push notifications if you install our mobile application.

Disclaimers

The Platform, tools, and Content are provided for educational purposes only and do not constitute financial, legal, tax, or investment advice, and do not create any fiduciary, advisory, or professional relationship. You remain solely responsible for your decisions and should consult a licensed financial adviser before acting.

The Platform, tools, and Content are provided "as is" and "as available", without any warranties (express, implied, or statutory), including warranties of title, merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant uninterrupted, error-free, or virus/malware-free operation, or that defects will be corrected. We have no duty to monitor or update any Content.

Models and simulations are algorithmic or educational in nature and may not reflect real-time markets. You must verify outcomes and assume all risks arising from your use.

We are not responsible for any loss, corruption, or unauthorized access to data transmitted to or stored on our systems, and you acknowledge that internet transmissions may be insecure. You should maintain appropriate backups.

We are not responsible for third-party content, services, tracking or attribution failures, payment intermediaries, brokers, Partners, or their actions or omissions. See Section 9 (Third-Party Links & Content) and Section 8 (Broker Partner Policy).

Limitation of Liability

To the maximum extent permitted by law, Justmindsettrade and its directors, employees, Partners, and service providers shall not be liable for any indirect, special, incidental, consequential, punitive, or exemplary damages, or for loss of profits, revenue, or data, arising from or related to security incidents, malware, unauthorized access, force-majeure events, maintenance, or other causes beyond our reasonable control, whether based in contract, tort (including negligence), or otherwise.

In all cases, our total aggregate liability to any individual User shall not exceed the total amount you paid to us (if any) in the twelve (12) months preceding the event giving rise to the claim, in the aggregate across all claims and theories of liability.

Your sole and exclusive remedy for dissatisfaction with the Platform is to stop using the Platform.

Nothing in these Terms excludes or limits any liability that cannot be excluded by law, including liability for fraud, wilful misconduct, or any non-excludable consumer-protection rights, and, where applicable, death or personal injury caused by negligence.

These disclaimers and limitations survive termination of your access to or use of the Platform.

Indemnification

You agree to indemnify Justmindsettrade, any Partners, and their respective officers, directors, employees, successors, agents, and affiliates for any and all claims, damages, losses, and causes of action (including attorneys' fees and court costs) arising out of or relating to your breach of these Terms or any materials in any form provided by you (or through your username and/or password). You agree to cooperate as fully as reasonably required in our defense and/or settlement of any claim. We reserve the right, in our reasonable discretion, to assume exclusive control over the defense and settlement of any matter subject to indemnification by you.

Geographic Restrictions & Sanctions

The Platform and Content are provided for educational purposes only. We are not a broker, investment adviser, or financial-service provider, and we do not target or market our Services into any jurisdiction where our tools are likely to be considered regulated activity or where prior authorisation, licence, or registration is required.

We do not onboard, contract with, or provide Services to any person or entity that is resident, located, incorporated, or otherwise subject to the laws of:

We may update or expand this list at any time without notice, and it automatically incorporates changes in applicable sanctions.

You represent and warrant that you are not located in, resident of, or otherwise subject to any restricted jurisdiction or applicable sanctions, and that your use complies with the laws of your jurisdiction. You agree to promptly notify us if your circumstances change.

We may implement technical and operational controls, including geo-blocking, account suspension or termination, and content or feature restrictions. Using VPNs or any circumvention method to bypass geographic or sanctions restrictions is prohibited and constitutes a material breach. We may deny registration, block access, void benefits, rebates, or payments, or close accounts at our sole discretion and without prior notice if a breach is detected. We may process location signals — such as IP address and device or account identifiers — in accordance with our Privacy Policy for compliance screening.

Nothing on the Platform constitutes an offer, recommendation, or solicitation to persons in restricted jurisdictions, nor is any Content directed to such persons.

This section is provided for compliance clarity and is not legal advice. Where local consumer-protection or mandatory laws apply, those laws prevail.

Term, Suspension & Termination

These Terms apply for as long as you access or use the Platform. You may stop using the Platform at any time and, where applicable, close your account. We may, at our sole discretion and with or without notice, suspend, restrict, or terminate your access to all or part of the Platform — including for any breach of these Terms, suspected unlawful activity, failure of verification, or where required by law. Upon termination, your right to use the Platform ceases immediately. Sections that by their nature should survive termination — including Sections 10 (Intellectual Property), 12 (Disclaimers), 13 (Limitation of Liability), 14 (Indemnification), 17 (Governing Law & Dispute Resolution), and 18 (General Provisions) — will survive.

Governing Law & Dispute Resolution

These Terms and any non-contractual obligations arising out of or in connection with them are governed by the laws of Thailand.

The courts of Thailand shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms, except that if you are a consumer resident outside Thailand, any mandatory consumer-protection laws and the courts of your habitual residence will also apply where required by law.

Before filing any claim, the parties will attempt in good faith to resolve the dispute by contacting support@justmindsettrade.com and allowing 60 days for resolution. This requirement will be deemed satisfied if the other party (i) rejects the claim in writing, (ii) fails to respond within 10 business days, or (iii) refuses to participate in the process. Nothing in this clause prevents either party from seeking urgent injunctive relief. Unless required by law, this clause does not toll any applicable limitation periods.

General Provisions

We shall not be liable for any delay or failure to perform resulting from causes beyond our reasonable control, including acts of God, natural disasters, epidemics, war, terrorism, civil unrest, government action, labor disputes, power or internet failures, or failures of third-party services or infrastructure.

You may not assign or transfer these Terms or any rights or obligations under them without our prior written consent. We may assign or transfer these Terms, in whole or in part, without restriction, including in connection with a merger, acquisition, reorganization, or sale of assets.

We may provide notices to you by posting on the Platform, by in-product message, or by email to the address associated with your account. You may contact us at support@justmindsettrade.com. Notices are deemed received when posted or sent.

If any provision of these Terms is held to be invalid or unenforceable, such invalidity shall not affect the remaining provisions, which shall continue in full force and effect.

Any failure to enforce any provision of these Terms will not be deemed a waiver of that provision. Any waiver of any provision on one occasion will not be deemed a waiver of any other provision or of such provision on any other occasion.

These Terms, together with the documents expressly incorporated by reference (including the Privacy Policy, Risk Disclosure, and any other policies or notices posted on the Platform, in each case as updated from time to time), constitute the entire agreement between you and Justmindsettrade regarding the Platform and Services, and supersede all prior or contemporaneous agreements, proposals, or representations, whether written or oral, including any earlier version of these Terms.

In the event of any conflict or inconsistency between these Terms and any incorporated document, these Terms control unless the incorporated document expressly states that it prevails for that specific conflict.

You acknowledge that you have not relied on any statement, promise, or representation not set out in these Terms or the incorporated documents.

No waiver, modification, or amendment of these Terms is effective unless in writing and issued by Justmindsettrade.

These Terms may be provided in more than one language. In the event of any discrepancy between different versions, the English version shall prevail and be considered the authoritative version.
